Welcome to postfast. These Terms of Service ("Terms") govern your access to and use of postfast's website, application, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

postfast is a social media management platform that allows you to:

• Connect and manage multiple social media accounts (X/Twitter, Bluesky, and others)
• Create, schedule, and publish posts across multiple platforms
• Manage your social media content and posting schedule in one place
• Access analytics and insights about your social media presence

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3.1 Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. By creating an account, you represent and warrant that you meet this age requirement and that all information you provide is accurate and current.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your password is strong and secure

3.3 Account Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4.1 Authorization

When you connect a social media account to postfast, you authorize us to:

• Access your account information and profile details
• Publish posts on your behalf
• Retrieve analytics and engagement data
• Perform actions necessary to provide the Service

4.2 Third-Party Terms

Your use of connected social media accounts is subject to the terms and policies of those platforms, including:

• X (Twitter) Terms of Service and Developer Agreement
• Bluesky Terms of Service
• Any other platform you connect

You are responsible for complying with all applicable third-party terms. We are not responsible for any actions taken by third-party platforms or their policies.

4.3 Disconnecting Accounts

You may disconnect any social media account at any time through your account settings. When you disconnect an account, we will stop accessing that account, but previously posted content will remain on the platform.

5.1 Your Content

You retain all rights to the content you create, upload, or post through the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free, worldwide license to:

• Store, process, and transmit your User Content to provide the Service
• Publish your User Content to the social media platforms you've connected
• Use your User Content to improve and develop the Service

5.2 Content Responsibilities

You agree that your User Content will not:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Contain malware, viruses, or other harmful code
• Harass, threaten, or harm others
• Contain hate speech, discrimination, or violent content
• Promote illegal activities or fraudulent schemes
• Impersonate others or misrepresent your affiliation

5.3 Content Monitoring

We reserve the right, but have no obligation, to monitor, review, or remove User Content that violates these Terms or is otherwise objectionable. We are not responsible for User Content or the consequences of posting or publishing it.

You agree not to use the Service to:

• Engage in automated posting or spam
• Attempt to gain unauthorized access to the Service or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service for any commercial purpose without our prior written consent
• Interfere with or disrupt the Service or servers
• Scrape, collect, or harvest user data without permission
• Circumvent any security features or usage limits
• Use the Service to send unsolicited communications

7.1 Our Rights

The Service, including its design, features, functionality, and content (excluding User Content), is owned by postfast and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7.2 Trademarks

postfast, our logo, and other marks are trademarks of postfast. You may not use these trademarks without our prior written consent.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without any obligation or compensation to you.

8.1 Pricing

We may offer both free and paid subscription plans. Pricing is displayed on our website and may change at any time. We will provide notice of price changes for existing subscribers.

8.2 Billing

For paid subscriptions:

• You authorize us to charge your payment method
• Subscriptions automatically renew unless cancelled
• You are responsible for all charges and taxes
• Payment information must be accurate and current

8.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial billing periods except as required by law.

8.4 Free Trials

We may offer free trials for paid features. If you do not cancel before the trial ends, you will be charged for the subscription. We reserve the right to limit or revoke free trials.

You agree to indemnify, defend, and hold harmless postfast and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

12.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@postfast.app to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

12.2 Arbitration

If we cannot resolve a dispute informally, any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration, except as provided below. Arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA).

12.3 Exceptions

Either party may bring a claim in small claims court or seek injunctive relief for intellectual property infringement.

12.4 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and postfast individually. To the extent permitted by law, you waive the right to participate in a class action, collective action, or representative action.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in the United States, and you consent to the jurisdiction of such courts.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and data
• All provisions that should survive termination shall survive

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and postfast regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service failures.
